These Terms and Conditions ("Terms") govern your access to and use of TuCreator, a platform operated by Only4Fitness Ltd, a company incorporated in the United Kingdom with its office at 27 Old Gloucester Street, London, UK ("we", "us", or "our"). By accessing or using TuCreator, you agree to comply with these Terms. If you do not agree with these Terms, you must not use the Platform.

1. Platform Overview

TuCreator is an online platform that allows content creators ("Creators") to upload, sell, and socialize with followers. The Platform does not operate on a subscription basis but instead allows Creators to sell their digital creations directly to users ("Followers") in exchange for payments.

2. Account Creation

To use TuCreator as a Creator, you must register for an account by providing accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

• You must be at least 18 years old to use TuCreator.
• You agree to provide truthful and accurate information in your profile and content.

3. Content Upload and Monetization

• Original Content: You are responsible for uploading only original content. You may not upload, share, or promote any content that violates intellectual property laws, is defamatory, obscene, or otherwise illegal.
• Content Pricing: Creators set their own prices for locked (paid) content. By uploading paid content, you agree that users must pay to access such content.
• Payment Terms: Creators will receive 80% of each sale made on the Platform. Payments are processed weekly via the chosen payment method (e.g., PayPal or Stripe).

4. Prohibited Content

The following activities and content are strictly prohibited on TuCreator:

• No Child Exploitation or Adult Content: TuCreator does not allow the posting of content that exploits or harms minors in any way. Content containing explicit adult content, pornography, or any form of exploitation is strictly prohibited.
• No Illegal Content: You may not upload content that promotes or supports illegal activities, including but not limited to prostitution, trafficking, or any form of exploitation.

5. Creator Responsibilities

As a Creator, you agree:

• To comply with all applicable laws and regulations in your jurisdiction.
• To pay all taxes and fees associated with your earnings, as required by the law.
• To be responsible for all content you upload and all interactions with Followers.
• To monitor and report any abuse or violations of these Terms using the provided email: support@tucreator.com. We will address all reported issues within 72 hours of notification.

6. User Responsibilities

Users of TuCreator agree:

• Not to misuse the Platform or attempt to hack or disrupt its services.
• To respect the rights of Creators and other users.
• To use the Platform in accordance with these Terms and all applicable laws.

7. Platform Intermediary Status

TuCreator acts solely as an intermediary, providing a space for Creators to share their content with Followers. We are not responsible for the content uploaded by Creators, nor for any interactions that occur between Creators and Followers. You use the Platform at your own risk.

8. Reporting Violations

If you encounter any content that violates these Terms, you are encouraged to report it immediately via email to support@tucreator.com. We will respond to the issue within 72 hours and take appropriate action, which may include content removal or account suspension.

9. Payments and Taxes

• Creator Earnings: Creators will receive 80% of the sale price for each content transaction.
• Payment Methods: Payments are processed via PayPal or Stripe and will be made within 72 hours of a withdrawal request.
• Taxes: It is the responsibility of the Creator to report and pay any applicable taxes related to their earnings from TuCreator.

10. Intellectual Property

• Ownership of Content: Creators retain ownership of the content they upload to the Platform, subject to TuCreator’s right to use the content as outlined in these Terms.
• License to Use Content: By uploading content to the Platform, you grant TuCreator a non-exclusive, royalty-free, and worldwide license to use, display, and distribute your content as necessary for the operation of the Platform.

11. Liability and Disclaimers

• No Responsibility for Content: TuCreator is not responsible for the accuracy, legality, or quality of content uploaded by Creators. Creators are solely responsible for their content and its consequences.
• Limitation of Liability: TuCreator is not liable for any damages resulting from the use or inability to use the Platform, including but not limited to loss of profits, data, or business opportunities.

12. Platform Availability

TuCreator strives to provide uninterrupted access to the Platform but does not guarantee that it will be error-free or continuously available. We reserve the right to modify, suspend, or discontinue the Platform at our discretion.

13. Privacy Policy

Your use of TuCreator is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

14. Governing Law

These Terms are governed by the laws of the United Kingdom. Any disputes will be resolved in the courts of London, UK.

15. Indemnity Clause

Creators agree to indemnify and hold TuCreator and its affiliates harmless from any claims, losses, damages, or legal expenses arising from their content or violations of these Terms. This includes any legal action resulting from content uploaded, interactions with Followers, or breaches of these Terms.

6. Dispute Resolution

Any disputes that arise out of or relate to these Terms, or your use of the Platform, will be resolved through binding arbitration rather than through court proceedings. The arbitration will take place in London, UK, and be conducted in English. Both parties agree to waive the right to a trial by jury.

17. Force Majeure

TuCreator will not be held liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, war, terrorism, strikes, or technical failures.
